Completion of, practice on, or scoring 100% on any practice test, mock exam, or specimen label exercise on this platform DOES NOT confer, grant, or substitute for official state or federal pesticide applicator certification or licensure. Official credentials can only be granted by authorized state lead agencies (such as State Departments of Agriculture) following successful completion of formal, proctored examinations administered by recognized testing authorities (e.g., PSI Services, Metro Institute, or designated university extensions).
1. Acceptance of Terms
By accessing, browsing, or utilizing the services provided on pesticideexam.org ("the Site", "Platform", "we", "us"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use and our accompanying Privacy Policy. If you do not accept these terms in their entirety, you must discontinue use of the platform immediately.
2. Intellectual Property Rights & Federal Public Domain Works
The proprietary code, test generation algorithms, design layout, styles, user interface, database compilations, and interactive decoders are the exclusive intellectual property of the platform operators and are protected under United States and international copyright laws.
Statutory texts cited throughout this platform—including the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA, 7 U.S.C. § 136 et seq.), Title 40 of the Code of Federal Regulations (40 CFR Parts 150–189), the Worker Protection Standard (40 CFR Part 170), and EPA Certification Standards (40 CFR Part 171)—are public domain works of the United States Government under 17 U.S.C. § 105 and are cited herein for commentary, research, and non-commercial educational instruction.
3. Permitted Use & Prohibited Conduct
You are granted a revocable, non-exclusive, non-transferable license to access study modules, mock exams, and regulatory profiles for personal certification preparation. You agree NOT to:
- Deploy automated web crawlers, scrapers, data miners, or bots to harvest questions, answer keys, or statutory explanations.
- Resell, sublicense, syndicate, or mirror test modules on commercial learning management systems without written consent.
- Attempt to probe, scan, or compromise platform security, reverse engineer server APIs, or execute denial-of-service attacks.
- Use the site in violation of any applicable municipal, state, federal, or environmental protection law.
4. Accuracy of Statutory Information & Regulatory Evolution
While our editorial board strives to maintain rigorous alignment with current federal guidelines and state agricultural department standards across all 50 states, state pesticide rules, category numbering, and CEU renewal intervals undergo periodic administrative amendments. Applicators are responsible for independently verifying current scheduling dates, fees, and requirements directly with their state licensing board.

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
UNDER NO CIRCUMSTANCES SHALL THE OPERATORS, AUTHORS, OR CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO EXAM FAILURE, LOSS OF COMMERCIAL LICENSURE, APPLICATION CITATIONS, ENVIRONMENTAL FINES, OR BUSINESS INTERRUPTION ARISING FROM USE OF THIS SITE.
6. Governing Law & Jurisdiction
These Terms shall be construed and governed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising hereunder shall be subject to exclusive jurisdiction in the state or federal courts located in Travis County, Texas.
